HM Revenue and Customs (HMRC) has reminded employers of the imminent May 19th deadline for 2012-13 Employer Annual Returns. Business owners have been urged to complete their returns online as soon as possible in order to avoid late filing penalties.
 
The PAYE end-of-year forms (P35, P14 and P11D[b]) will incur late penalties of £100 per 50 employees for each month that a return remains outstanding after the deadline.
 
Employers should note that if a P35 or P14 return remains outstanding for more than four months, HMRC will dish out a penalty notice shortly after September 19th, and again the following January and May, if necessary. These penalty notices will reveal the full extent of taxpayer fines.
 
Those who do not have a requirement to file a 2012-13 P35 or P14 return should contact HMRC as soon as possible. The simplest way to do this is to use HMRC’s new ‘No Employer Annual Return to make’ e-mail notification.
 
Employers who send their P35 and P14 forms separately must ensure all parts have been sent to HMRC by May 19th. If someone else has sent part of the return on your behalf, i.e. a payroll agent or bureau, it is important to double-check that all parts have been submitted.
 
Employers who oppose the PAYE penalty notice have the right to appeal against the decision. For further information on appealing an HMRC decision visit HMRC’s guide to appeal section.
 
All small and medium-sized enterprises are affected by the changes in the reporting of PAYE in Real Time Information (RTI). Businesses who are not already reporting PAYE using RTI should act as soon as possible.
